October 16, 2006

The FOIP Regulation on this web site has been updated to include the amendments made to Schedule 1 by the Freedom of Information and Protection of Privacy Amendment Regulation (A.R. 247/2006), which came into force on October 11, 2006 (Order in Council 499/2006). The alphabetical list of public bodies has also been updated to incorporate these changes.

The dates for the 2006-2007 FOIP training sessions have been set. The first sessions for the fall 2006 are September 25, 26, and 27 in Edmonton and October 18, 19, and 20 in Calgary. The training calendar and registration form are available at foip.gov.ab.ca/dsp_training.cfm.

FOIP Bulletin No. 18, entitled FOIP Amendment Act, 2006, is now available on this web site.

The Freedom of Information and Protection of Privacy Amendment Act, 2006 came into force on May 24, 2006. This Act makes a number of amendments to the FOIP Act that affect the process of designating public bodies, access to records held by government ministries, and the processing of certain requests. The Amendment Act also places restrictions on the disclosure of personal information to courts that do not have jurisdiction in Alberta and creates a new offence and penalty for such a disclosure that is not permitted under the FOIP Act. This penalty provision extends to public body employees and contractors acting on behalf of public bodies.

The purpose of this bulletin is to provide the rationale for the new and amended provisions and to offer guidance on applying the amended provisions within public bodies. This bulletin discusses related amendments together rather than in the order in which they appear in the Act.

An updated printed office consolidation of the FOIP Act and Regulation is expected to be available for purchase from the Queen's Printer in early June.

The FOIP Regulation on this web site has been updated to reflect the amendments made by the Freedom of Information and Protection of Privacy Amendment Regulation (A.R. 27/2006), which came into force on April 1, 2006 (Order in Council 54/2006).

An updated printed office consolidation of the FOIP Act and Regulation is expected to be available for purchase from the Queen's Printer in the near future. Unofficial printable inserts of recent amendments are available to update your consolidation as an interim measure.

The Freedom of Information and Protection of Privacy Amendment Act, 2006 (Bill 20) was introduced in the Legislature on Tuesday, March 7, 2006. The amendments:

  • Introduce a new provision and higher penalties for disclosing personal information in response to a court order from outside of Canada, in contravention of the Act.
  • Allow a newly created government agency, board, commission or committee to be made subject to the FOIP Act more quickly, by Ministerial Order.
  • Allow a public body to be deleted from Schedule 1 of the FOIP regulation when the organization is a local public body, or should more appropriately be subject to other access and privacy legislation.
  • Suspend the processing of a request while the Information and Privacy Commissioner consults with an applicant on whether to allow a public body to disregard a FOIP request.
  • Limit access to certain government records for a prescribed period.
  • Clarify that the FOIP Act does not apply to the published works in a library.
