Ministerial Regulations
Section 94(3) of the FOIP Act allows the Minister responsible for the Act, to designate an agency, board, commission, corporation,
office or other body as a public body by regulation. The Minister may make
such a regulation in accordance with the same criteria that apply to designation
of a public body by the Lieutenant Governor in Council, but may do so only at the request of the Minister responsible for that agency, board, commissioner, corporation, office or other body.
A ministerial regulation made under section 94(3) is repealed on the coming into
force of a regulation made by the Lieutenant Governor in Council which
designates the body as a public body in Schedule 1 of the FOIP Regulation.
